Terms and Conditions

The following terms and conditions represent the basis upon which I, Andy Hayward (owner of Hayward Driving School), offer driving lessons to you, the student.

My committment to you

I will be courteous, polite, tidy and punctual. I will behave in a professional and ethical manner at all times. My car will be well maintained, clean and tidy. My car is fitted with dual-controls and is fully insured for driving tuition purposes. Hayward Driving School agrees to the DVSA Voluntary Code of Conduct.

Qualifications

I am a fully qualified DVSA Approved Driving Instructor, registered from 2019. I am on the DVSA approved driving instructor list. I am legally authorised to give driving tuition in the UK by the Driver and Vehicle Standards Agency (DVSA).

Driving Licence

You must hold a current, valid driving licence (provisional or full), which must be produced on or in advance of our first driving lesson. You must prove your entitlement to drive and provide me with a licence check code prior to our first driving lesson. I can advise you how to do this.

Eyesight

You must check that you can read a number plate at a distance of 20.5 metres (i.e. 67 feet - about 5 car lengths) with prescribed visual aids (i.e. contact lenses or glasses) if normally worn. Please note if you need contact lenses or glasses to achieve this you must make sure you wear them on each and every driving lesson.

Health and ability to drive

Any motoring offences or health changes that may impact your ability to drive must be communicated to me immediately.

Safety, comfort and well being

Driving under the influence

To ensure the safety of you and other road users I reserve the right to cancel any lesson if you are or if I suspect you are under the influence of drugs, legal highs and/or alcohol (prescribed or otherwise). If this occurs the full training fee for the period in question will be lost or charged. All future lessons may be cancelled as a result.

Lesson postponement or cancellations

I reserve the right to cancel or halt any planned lesson in adverse weather conditions that, in my opinion, makes driving unsafe. If I need to cancel or change any planned lessons for any other reason I will always give as much notice as possible. You must give at least 48 hours notice to change or cancel any planned lessons. If less than 48 hours notice is given, I reserve the right to charge you for the full lesson price.

Punctuality

I will always endeavour to arrive at the date and time agreed for your lesson. If I expect to be more than 10 minutes late I will communicate this to you. I will make up any lesson time lost as a result of this at the end of your lesson or any future lesson if this is not possible. I would normally wait for you for a maximum of 15 minutes. If no communication is received from you or you simply do not show up I will abandon the lesson and charge you the full lesson fee.

The Driving Test

Bookings

Driving tests can be booked by you or me on your behalf. Any bookings must be checked with me prior to confirming with the DVSA. Driving test bookings always take priority over other lessons. Your lesson may be postponed to allow for someone else's driving test and vice-versa. Changes to lesson bookings as a result of this will be notified immediately. If you have prebooked your driving test before we commence lessons you must notify me at the point of enquiry.

Use of the vehicle

In the interest of your safety, and that of other road users, I reserve the right to refuse the use of my vehicle for your test if I believe your driving is not up to test standard or the level required is not achievable in the time frame.

Test cancellation

Three clear working days (Sundays and public holidays are not included) notice of test cancellation or postponement is required by the DVSA. Therefore to cancel a test booked for a Friday you need to do this online no later than the preceding Monday thus giving three clear working days (i.e. Tuesday, Wednesday and Thursday). Failure to provide the required notice will result in the loss of your test fee. I cannot be held responsible for any postponement or cancellation of tests by you or the DVSA. However, I will do all that is possible to help you arrange another test and to help you to reclaim expenses from the DVSA if appropriate.

Payments

Payments are to be made by bank transfer only. All lessons must be paid for at least 48 hours in advance.

Pricing

The prices displayed on my website are current however I reserve the right to review these on a regular basis. Any change in prices will be updated on my website and relayed to you should it affect your lesson costs.

Termination of contract

If at any time you wish to terminate your lessons with me, at least 7 days notice must be given. At that point, any unused credit will be refunded. I reserve the right to charge any lessons scheduled within the 7 day period.

Complaints

In the event of a complaint, please bring this to my attention as soon as possible to allow me to the opportunity to resolve it. If this is not possible please refer to the DVSA.
